Mr. Franklin is an expert in financial services laws, anti-money laundering (AML) regulations, know-your-customer (KYC) requirements and data protection policies. Coupled with his deep knowledge on smart contract functionality and distributed ledger technology, he helps clients understand the legal implications of implementing blockchain-based solutions.
Mr. Franklin provides legal advice on regulations related to blockchain technology, CBDCs, cryptocurrencies, stablecoins, and related digital assets. Mr. Franklin also advises clients on the legal risks of tokenized assets – both fungible and ‘non-fungible,’ to ensure clients act within the regulatory compliance framework.
Specifically, for clients offering digital asset products, Mr. Franklin reviews smart contract code that addresses intellectual property rights, privacy, and data security concerns. Additionally, Mr. Franklin advises clients on the regulatory risks of initial coin offerings, token sales and other digital asset offerings, exchanges, and transactions as relevant under the Commodities Exchange Act and/or the Securities Acts of 1933 and 1934.
